Importing Trademarked and Copyrighted Goods How to Avoid Seizure Risks and Legal Liabilities

Importing popular goods—especially fashion items, IT equipment, toys, accessories, or foreign brand-name products—often involves Trademarks or Copyrights. These intellectual properties are strictly protected under Thai and international laws.
Many importers experience delays, goods being seized at customs, or even criminal prosecution due to a lack of understanding regarding brand-name imports. This article explores key warnings and compliant import practices to protect your business.

1. Clear Distinction: Which Goods Risk Violating Customs Laws?
Thai Customs maintains strict border and port measures to combat intellectual property infringements, categorizing high-risk goods into three main groups:
  • Counterfeit Goods: Products that imitate famous brands—whether by copying logos, prints, or designs—to mislead buyers into believing they are genuine (considered the most severe violation).
  • Pirated Goods: Products that copy creative works without permission from the copyright holder, such as popular cartoon characters, graphic designs, fabric patterns, or software.
  • Parallel Imports / Unauthorized Gray Market Goods: Genuine products imported for domestic sale without proper rights or a written consent letter from the brand’s trademark owner in Thailand. If the brand owner has registered import protection with Thai Customs, these goods will be detained immediately.

2. Penalties and Consequences of Importing Infringing Goods
If customs officers or authorities detect infringing imports, the following consequences apply:
  • Seizure and Destruction of Goods: The products will be seized by the government and destroyed, with the importer bearing all destruction expenses.
  • Criminal Penalties and Heavy Fines: Under the Customs Act, Trademark Act, and Copyright Act, offenders face up to 4 years imprisonment, fines up to 400,000 THB, or both.
  • Customs Blacklisting: The importing company's profile will be flagged as High Risk, causing all future shipments to go through the Red Line channel (100% physical inspection).

3. Key Documents Required for Legitimate Brand Imports
To prove to customs officers that your goods are legally imported and to avoid delays at the border, prepare the following documents:
  • Letter of Authorization (LOA): Issued by the foreign trademark or copyright owner appointing you as a distributor.
  • Customs Clearance Authorization Letter: Clearly specifying the Thai importing company's name, accompanied by authorized signatures and official company stamps.
  • Licensing Agreement: Required for copyrighted cartoon characters or specific proprietary designs.
  • Standard Commercial Documents: Commercial Invoice, Packing List, and Bill of Lading (B/L), all consistently specifying the brand name and model.

4. 4 Safe Practices for Importing Branded Goods
1. Check Intellectual Property Registration Status: Verify with the Department of Intellectual Property (DIP) and Thai Customs whether the brand has registered for border protection.
2. Avoid "Grade A" Copies or Character Merchandise: Unless you hold an official license, do not order goods printed with famous cartoon characters or inspired by luxury bag silhouettes, even if overseas suppliers claim they are "equivalent quality."
3. Declare Accurate Information: Correctly specify the brand name and model on the import declaration form. Never conceal brand details or declare items as "Unbranded," as failing a Red Line inspection constitutes false declaration.
4. Consult a Customs Broker Before Purchasing: Before transferring funds overseas, send product photos and brand details to a professional customs broker to assess risks and check legal requirements in advance.

Summary:
Importing trademarked and copyrighted goods is straightforward when legal procedures are followed. Having valid consent letters and documentation not only ensures smooth customs clearance, but also builds business credibility for sustainable long-term growth.
